1. Do I lose my driver’s license?
California DUI law cases have two prongs: 1) The criminal case, and 2) The DMV case. Following a DUI arrest in Riverside, the police officer exchanges the defendant’s driver’s license with a pink, temporary license good for thirty days. Defendants then have ten days to contact the Department of Motor Vehicles to ask for a DMV hearing to contest the license suspension.
During the DMV hearing, the defendant’s criminal defense attorney can cross-examine witnesses and present evidence in an effort to show the defendant was not driving under the influence. Typical defenses are that the police did not administer the field sobriety tests correctly or that that the breathalyzer used for the chemical test was defective.
Note that even if defendants lose their DMV hearing, they may be able to continue driving with an ignition interlock device (IID) installed in their vehicle.
2. What is the criminal DUI sentence in Riverside?
Most of the penalties for a DUI conviction in Riverside are standard: Fines, probation, DUI school, and a license suspension. And defendants may be able to continue driving anywhere if they get an ignition interlock device (IID) installed.
However, Riverside courts also impose jail time. The sentencing is usually six to 10 days on a first DUI offense, 30 days on a second DUI offense, and at least 120 days in jail for third time DUI. People can usually serve the time as a work release rather than actually staying in a jail facility.
A good Riverside criminal defense lawyer can often negotiate with the prosecutor or judge to get jail time reduced or eliminated.
3. What is DUI School?
A standard sentence following a drunk driving conviction in California is a drug and alcohol education program. DUI school spans three to 30 months depending on the defendant’s blood alcohol content (BAC) and criminal history. Three of Riverside’s DUI schools are:
